Privacy Disclosure Statement and Declaration
1.1 About MyFinanceX and this policy
MyFinanceX is operated by MyFinanceX, ABN 94 052 813 818 (“MyFinanceX”, “we”, “us” or “our”). We are committed to protecting the privacy of our clients, website visitors and other individuals whose personal information we collect and handle in the course of our business. We aim to comply with applicable requirements of the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply to us.
This policy explains what information we collect, how it is used to assess potential finance options and facilitate enquiries, when it may be disclosed to finance providers, and how individuals can access, correct or raise concerns about their information. MyFinanceX is an intermediary and is not itself a lender.
1.2 Collection of Personal Information
MyFinanceX provides commercial finance information, enquiry and intermediary services. Depending on how you interact with us, we may collect personal information when you submit a business finance enquiry or application, contact us by phone or email, upload documents or use our website. Information may include:
- Name and contact details, including email address, phone number and mailing address;
- Financial information provided for a business finance enquiry, such as bank statements, liabilities, income and credit-related information;
- Business and employment information, such as business name, ABN, structure, industry, turnover and funding requirements;
- Identity information and supporting documents where reasonably required for verification; and
- Technical and usage information necessary to operate, secure and improve the website.
Where practicable, we collect personal information directly from you. Where appropriate and legally permitted, we may also obtain relevant information from authorised representatives, business registries, publicly available records or third-party verification services. We will provide any required notices and obtain any necessary consent before obtaining credit reports or conducting credit checks. An initial website enquiry does not itself constitute authorisation for a credit bureau enquiry.
1.3 How we use information and match finance options
We may use personal information to:
- Respond to enquiries and provide information about commercial finance products and services;
- Understand business funding needs and provide indicative product guidance;
- Prepare, arrange or assist with a commercial finance application at your request;
- Communicate with you about your enquiry or application;
- Verify information, help prevent fraud and maintain the security of our services;
- Administer our business and comply with applicable legal and regulatory obligations; and
- Carry out other purposes you have authorised or that are otherwise permitted by law.
We may use automated rules to compare information you submit with recorded lender product criteria and your stated preferences, such as speed, cost and flexibility. The resulting options are indicative and may be incomplete or require specialist review. They are not credit decisions, approvals, offers, or guarantees of price, timing or funding. Where automated matching is unsuitable or insufficiently supported, we may offer review by a lending specialist.
1.4 When we disclose information
In providing our services, we may need to share relevant information with third parties where appropriate, authorised or legally required. These may include:
- Lenders, finance providers or other recipients of a finance application you ask us to progress;
- Professional advisers, including accountants, legal advisers and auditors, where relevant;
- Technology, hosting, database, document storage, communications and identity verification providers who support our operations;
- Contractors, service providers or referral partners involved in delivering the services you request, subject to applicable notice and consent requirements;
- Regulators, courts, tribunals, law enforcement or other parties where disclosure is required or authorised by law; and
- Prospective purchasers or advisers in connection with a proposed sale or restructuring of the business, subject to applicable privacy obligations.
Some technology or service providers may process or store information outside Australia. The countries involved depend on the providers and arrangements actually used. We will take steps required by applicable law in relation to overseas disclosures.
Submitting an initial enquiry, selecting Express Loan Matching, viewing lender options or selecting a preferred lender does not, by itself, mean your information has been transmitted to that lender. We will explain the intended recipient and obtain any required authorisation before submitting your application or personal information to a finance provider. Where you authorise a referral, we may request relevant progress information from the provider, including whether an application was submitted, approved, declined, withdrawn or settled, for the purpose of assisting with your enquiry and maintaining accurate records.
1.5 Your choices, communications and rights
We may contact you using the details you provide to respond to your enquiry, discuss your finance options, request supporting documents or provide updates on your application. Marketing communications are separate from service-related communications; where we send marketing, we will comply with applicable consent and unsubscribe requirements. You may opt out of marketing using the unsubscribe method provided or by contacting us. You may request access to or correction of personal information we hold about you. You may also ask us to delete information or withdraw consent where applicable. These requests are subject to legal obligations, record-keeping requirements and other applicable exceptions; deletion or withdrawal may not always be possible. Please contact us at ben@myfinancex.com.
We may need to verify your identity before responding to a request. If you do not provide information reasonably needed for an enquiry or application, we may be unable to assess your funding requirements, verify relevant details or help arrange finance.
If you have a privacy complaint, contact us using the email above so we can investigate. If you are dissatisfied with our response, you may be able to raise the matter with the Office of the Australian Information Commissioner at oaic.gov.au.
1.6 Security, retention and third-party services
We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Information may be held in cloud-based systems and other electronic storage used to operate our services. Access to customer information is restricted according to operational needs, and we use appropriate access controls and safeguards for systems that handle application information. No method of internet transmission or electronic storage is completely secure, so absolute security cannot be guaranteed.
We retain personal information for as long as reasonably necessary for our services, legitimate business purposes and applicable legal obligations. When it is no longer required, we take reasonable steps to destroy or de-identify it where appropriate.
1.7 Credit information and credit checks
We may ask whether you are aware of credit issues as part of an initial finance enquiry. This information helps determine whether a lending specialist should review the enquiry. MyFinanceX does not currently perform an automated personal credit bureau enquiry merely because you use the website, request matching or submit an initial enquiry. If credit reporting or identity-check services are introduced, we will provide any legally required notices, verify that access is permitted and obtain any required specific authorisation before using them. A lender may have its own credit assessment and consent requirements if you decide to proceed with that lender.
1.8 Changes to this policy
We may update this policy from time to time to reflect changes to our services, information handling practices or applicable laws. The current version will be published on this page with an updated date. We encourage you to review it periodically.
